And when I die . . .

Do you know the song? Blood, Sweat & Tears, released in 1968 – one of my favorites. It’s a simple song with a soothing melody. The lyrics hold many truths and one stanza summarizes what virtually all of us hope for:

Give me my freedom for as long as I be

All I ask of living is to have no chains on me

All I ask of living is to have no chains on me,

And all I ask of dying is to go naturally, only want to go naturally

Don’t want to go by the devil, don’t want to go by the demon,

Don’t want to go by Satan, don’t want to die uneasy,

Just let me go naturally

 

The chorus, which carries the song’s title, addresses the need to transition:

And when I die and when I’m dead, dead and gone,

There’ll be one child born and a world to carry on, to carry on

And there you have it – a song that states what we all seek to accomplish with proper Estate Planning and a later stage of life that goes, reasonably, according to plan. The goal is to die naturally; without painstaking medical procedures to preserve life beyond its reasonable limits. Additionally, we want to transition our estate to those who will carry on – typically our surviving spouse, children, and grandchildren.

Most of us can’t sing or write songs like BS&T. The good thing is that we can use their song as a reminder that we all need to address the proper elements of an Estate Plan – so that we can transition our estate to our loved ones – and so we can maximize our goal to die peacefully and naturally. To do so, we need to make sure we have a proper Durable Power of Attorney and Health Care Power of Attorney in place, as well as a Will and Trust – to transition our assets in such a way that they don’t end up in the hands of our children’s creditors, or the children of our spouse who remarries after we die. These are the problems avoided with proper planning.

The lesson learned here is that proper planning will prepare you for the inevitable. As is stated in the song:

I’m not scared of dying and I don’t really care If it’s peace you find in dying,

well, then let the time be near
