Do you have an estate plan? You know… a Will, a Trust, Patient Advocate and Durable Power of Attorney? The biggest question is, “Is your house in order?” By that, I mean two things – if you die, have your taken the steps to protect your family? Secondly, if you live, have you taken the necessary steps to protect you and your family in case you are living but unable to act? There are scary thoughts. The Estate Plan creates the documents needed to prepare for these events – yes, the events no one wants to talk about and too often fail to prepare for.
If the Pandemic has taught us anything, it has taught us that we are often not prepared for the future. I have counseled many people recently who have lost a loved one to the Pandemic. The virus is unrelenting; it does not care how old you are. Yes, the mortality rate is improving, but in the end, it’s a numbers game – and even with the proper social distancing precautions – distance, mask, washing hands – the lesson learned is that we are all at risk – whether from the Pandemic or other life ending or changing events. To protect yourself and your family, an Estate Plan is essential.
The Patient Advocate/Medical Power of Attorney is an Estate Plan document that everyone needs. If you are hospitalized, you may be alone . . . no one may be allowed to be with you due to no visitor policies. The Patient Advocate gives you the protection needed. It allows someone on the outside of the hospital to be your medical advocate… make medical decisions on your behalf if you are not capable. It protects you from the hospital itself and assures that you have an extra pair of eyes involved. Remember, the hospital worries first about the hospital. Your patient advocate worries only about YOUR best interests. The Durable Power of Attorney is equally important. If you are unable to operate your business or handle your financial affairs, your appointed attorney in fact (typically your spouse or a child) is able to step in and protect your financial future. The Living Trust is critical. When funded correctly, your family avoids having to probate your estate. Dying imposes a difficult burden on those who are already emotionally burdened from your passing. You need to take the steps now so that the time, cost and public exposure of probate is avoided.
