As counsel to commercial developers and tenants and residential apartment developers, we are experienced in negotiating, drafting, litigating and arbitrating commercial and landlord/tenant issues.
THAV GROSS regularly provides representation to clients entering into office, warehouse and strip center leases. Leases are an area where there are many issues that need tenant protection from the customary “landlord” lease.
Our representation includes not only negotiation and preparation of necessary real estate purchase and sale documents, but also the representation of developers before local zoning boards, government agencies and lending institutions. We have also represented numerous clients for loan workouts, foreclosure actions, construction design claim prosecution and defense, as well as construction lien claim representation for lenders, owners and contractors.
A key are of specialty, is our representation of new home buyers purchasing custom constructed homes. When hiring a builder to construct a new home, there are major issues that need to be addressed to protect the homeowner and the agreements provided by the builder do not address the issues. These transactions, while common, are fraught with potential problems due to cost overruns, unexpected construction issues and builders that run into financial problems while construction is under way.
